Domain names Terms & Conditions

By signing up for any of our services you agree to be bound by all @UK PLC’s terms conditions and Policies.

By registering a .uk domain name, you enter into a contract of registration with Nominet UK on the following terms and conditions http://www.nominet.org.uk/registrants/aboutdomainnames/legal/terms/

ICANN top level names such as .Com, .Net, .Org, Name, biz and .info registrations are subject to the ICANN Uniform Domain Name Dispute Policy http://www.icann.org/dndr/udrp/policy.htm

By registering a .eu domain name, you enter into a contract of registration with EURID on the following terms and conditions

Additional @UK PLC terms and conditions for the registration Domain Names

  1. Your domain name application will not be registered until @UK PLC receives actual payment of the registration fee. If @UK PLC does register a domain name prior to payment of the registration fee, we reserve the right to cancel that registration or restrict use of the domain name until payment has been received.

  2. Domain names are not deemed to be successfully registered until they appear in the relevant Whois database of the top level domain name registrar. In the event that a domain name is unavailable when we attempt to register it @UK PLC will provide a full refund for that domain name, this will be the full limit of our liability.

  3. The Consumer Protection (Distance Selling) Regulations 2000

    Under the terms of The Consumer Protection (Distance Selling) Regulations 2000, consumers have a 'cooling off' period of 7 working days from the date that the order is placed in which they may cancel orders placed by distance contract. However, the consumer's right to cancel does not apply where goods or services are clearly personalised or made to the consumer’s specifications, or once service provision has begun.

    Domain names are personalised to the consumer's specifications and service provision begin from the moment the domain name registration is submitted to the registration authorities. Therefore, the consumer's right to cancel does not apply and @UK PLC will make no refund for any domain name registration other than .uk domains as Nominet (the .uk registration authority) have a 7 days cancellation policy.

  4. In the event of a charge back by a credit card company or other payment provider of @UK PLC, the domain name registration shall be transferred to @UK PLC as the paying entity for the registration. @UK PLC may reinstate your domain name registration at its sole discretion upon its receipt of the registration or renewal fee.

  5. @UK PLC will provide notice at 30, 20, 10 and 7 days prior to the expiry date of your domain name as a courtesy, such notice will be sent by email at your last recorded email address. It is your responsibility to keep this contact email address updated. However the domain holder remains responsible for renewing the Registration of the domain name(s). @UK PLC will make reasonable endeavours to renew domains where the renewal fee has been paid. In the event that we are unable to renew a domain name and that domain name is subsequently lost, the limit of our liability shall be the renewal fee for that domain name.

  6. The domain holder guarantees that neither the registration of the domain name nor the manner in which it is used infringes the legal rights of any third party or any applicable laws and regulations.

    The domain holder shall indemnify and hold harmless his provider, @UK PLC, the Internet Corporation for Assigned Names and Numbers (ICANN), VeriSign Inc. and its subcontractors, and the members, shareholders, directors, officers, employees, affiliates and agents of each of them and all other persons involved in the registration process from and against any and all claims, damages, liabilities, costs, and expenses arising out of or related to the domain holder's domain name registration or the use of the domain by the domain holder or by third parties with his consent. This indemnification obligation shall survive the termination or expiration of the registration agreement.

  7. Domain holder guarantees that the contact data given are accurate and complete. The Domain holder shall immediately inform @UK PLC on any updates and respond within fifteen calendar days to inquiries, on request guaranteeing up-to-date accuracy and completeness. Contact data include:

    • Full name and postal address of the domain holder, if domain holder is an organization, association or corporation: name of authorized person for contact purposes;
    • full name, postal address, e-mail address, voice telephone number and (where available) fax number of the technical contact for the domain;
    • if domain holder provides own name servers: Additionally IP addresses of the primary and secondary name server for the domain including corresponding name of those name servers.

  8. Domain holder acknowledges and accepts that this data can be published and made available to anybody in public data storage units, together with his domain, date of registration and expiration.

  9. We will cancel, transfer or otherwise make changes to domain name registrations under the following circumstances:

    • Our receipt of written or appropriate electronic instructions from you or an authorized agent to take such action;
    • Our receipt of written or appropriate electronic instructions from a law enforcement authority, court or arbitral tribunal.
    • Our receipt of a decision of an Administrative Panel requiring such action in any administrative proceeding to which you were a party and which was conducted under this Policy or a later version of this Policy adopted by ICANN. (See Paragraph 4(i) and (k) below.) We may also cancel, transfer or otherwise make changes to a domain name registration in accordance with the terms of your Registration Agreement or other legal requirements.

Web and Email Hosting Terms & Conditions

Web Site Hosting

  1. The main purpose of any site must be to provide web-based content to viewers. Files on the site must be linked to the web site The main purpose of any script must be to produce a web page. Scripts that send a single email based upon user entered information, or update a database are acceptable. Scripts that send bulk email or perform processor intensive database processes are not allowed.

  2. @UK PLC is not responsible for customer programming issues other than ensuring that programming languages such as Perl, PHP and ASP are installed and functioning on the web hosting system.

  3. The customer will be responsible for the content of your site. Sites must not contain copyright or other illegal material. The onus is on the customer to prove their rights to material published.

  4. The Internet is intended for use by mature adults and by minors under adult supervision. Users of our directory-based system are expected to use the Internet responsibly, obeying all laws and following proper ‘netiquette’.

  5. The following practices will not be tolerated:
    1. Unlawful activities such as unauthorised distribution or copying of copyrighted photos, materials or software
    2. fraud
    3. the solicitation of gambling or prostitution
    4. other practices which may be considered obscene and/or illegal.

  6. UK PLC reserves the right to suspend or cancel a customer's access to any or all services provided by @UK PLC, where the account has been inappropriately used.


Webmail Hosting

@UK PLC’s WebMail service is provided to you ('user') under the terms and conditions contained in this agreement. By using this service you agree to be bound by these terms and conditions.

WebMail requires internet access from a computer with an internet connection and a suitable web browser or email client. You are responsible for providing, and paying for, your own internet access including all equipment and software necessary to accomplish this

Mailboxes
  1. If @UK PLC identify a mailbox or domain that is causing problems; we will either remove the offending mailboxes or change their settings to resolve the issue. In extreme cases, we will disable email or suspend all services to the domain as appropriate

  2. @UK PLC’s Webmail system must not be used for any of the following mail abuse, including:
    1. Message delivery considered to be spamming
    2. Mail bombing (sending numerous and very similar messages to the same e-mail addresses)
    3. trolling (generating outrageous messages with the purpose of generating greater response)
    4. Subscribing others to a mailing list without permission.
    5. Any other practice either unlawful or considered harassment, and the owner of this system reserves the right to determine what constitutes net mail abuse.

  3. Users are given a maximum permissible storage size. This limits the total amount of mail that can be stored in all mailboxes created. When this size is exceeded any additional email received will be returned to the sender with a notice that the recipient's mailbox is full. Users may upgrade their account to larger storage sizes and/or to enable other features for a fee.

    It is the sole responsibility of the user to periodically delete email and attachments to help prevent the mailbox from reaching its size limitation.

Password Security

  1. When you sign up for this service your @UK password will be used for access to your Email Administration Page.
    It is your responsibility to protect and keep this password in such a way to prevent inadvertent disclosure to others. You may change your password at any time by changing the password on the default (postmaster) email account.
    @UK PLC encourages you to change your password regularly.

Spam

  1. Spam is unsolicited bulk email. You acknowledge that @UK PLC uses techniques to block mail sent from known spammers. This service is designed to protect our users from receiving spam.

Service availability

  1. @UK PLC aims to deliver the highest possible levels of up-time

Modifications

  1. @UK PLC reserves the right to modify any portion of or discontinue the WebMail without prior notification to the user. @UK PLC shall not be liable to any user or third party should it exercise its right to modify or discontinue the WebMail service.

  2. @UK PLC may from time to time change or modify this agreement. This agreement is always available to be viewed online. Should you not agree with any changes or modifications to this agreement you may not continue to use the @UK PLC WebMail service.

Termination

  1. You agree that @UK PLC may terminate and delete any webmail account where the user has allowed their WebMail service to expire and not attempted to renew in at least a three month period.

  2. You agree that @UK PLC may terminate this agreement and your use of this WebMail service if @UK PLC in its sole discretion believes that you have failed to comply with any of these terms and conditions.

  3. You acknowledge and agree that any termination of this WebMail service under any provision of this agreement may be effected without any prior notice, and agree that @UK PLC may immediately thereafter delete any email files stored by it for you.

Email Forwarding Hosting

@UK PLC’s email forwarding service is provided to you ('user') under the terms and conditions contained in this agreement. By using this service you agree to be bound by these terms and conditions.

@UK PLC will provide the email forwarding service on a good faith, best effort basis, but makes no claims of guaranteed uptime for the email services.

@UK PLC is not responsible for any defects, lost messages and/or risks that exist in the mail forwarding service, or any resulting loss or problems associated with any such defects or risks. Such defects and/or risks include, without limitation, the risk of loss of Source Material(s) sent over the Internet, the lack of confidentiality of material sent over the Internet, the passing of viruses and the inaccuracy of messages rendered by the mail forwarding service.

@UK PLC will not guarantee assistance, including any technical or customer support, in the use of the mail forwarding service, and your use of the mail forwarding service is at your own risk.

@UK PLC reserves the right to modify any portion of or discontinue the email forwarding without prior notification to the user. @UK PLC shall not be liable to any user or third party should it exercise its right to modify or discontinue the email forwarding service.

@UK PLC may from time to time change or modify this agreement. This agreement is always available to be viewed online. Should you not agree with any changes or modifications to this agreement you may not continue to use the @UK PLC email forwarding service.
